A grey area would be to replace the video with generic video and replace the data with other data (the data format for the games and database has already been reverse engineered) - or does not contain any data which is not copyrightable normally (such as a game score or moves leading to a well known position which doesn't contain any analysis). In that way you'd have something that runs on ChessBaseReader but doesn't contain any of the sensitive copyright bits.
