Its possible the installer just failed to copy it for some reason, but the windows VER doesn't have this file either. Testing in ver 44 works fine, but will not start because it thinks I am using an outdated graphics card. It gives the message "Make sure your system meets the requirements". Adding more support for Direct3DCaps will definitely be a step in the next direction to getting this game to actually run.
