The Mac driver translates those same styles and properties to the window not appearing in Exposé/Mission Control. In other words, this is by design. It's important for things like menus, tooltips, etc. to behave properly. Of course, it's undesirable in certain cases, such as yours, where it negatively impacts usability. It would help to know what app you're talking about and how it behaves on Windows.
