I tried injecting this into some testcases:

int nodelay = 1;

 if(setsockopt(sock, IPPROTO_IP, TCP_NODELAY, (char*)&nodelay, 
sizeof(nodelay)) < 0){
        trace("TCP_NODELAY failed: %d\n", WSAGetLastError());
        WSACleanup();
        return;
    }

and tests don't fail for me
attached ugly dirty fast patch  for sock.c to test it
