What graphics card/drivers do you have? What screen depth are you using? Are you talking about the system icon/Triforce? I thought you wre talking about the black area between the menu and the game.
Might be an ATI drivers issue. Can someone else with ATI test this please? I'll try in on a couple more machines when I get a chance.

Black toolbar instead of gray? I'm not getting the color washout you are, but it isn't registering properly as it does in the windows screenshot you provided.
