Created a test file: test.c containing 
#include "windows.h"
void main() {
    HANDLE hand = CreateFileA("test.c", FILE_ALL_ACCESS, 0, NULL, CREATE_NEW, 
0, NULL);
    printf("hand = %d (%d)\n", hand, GetLastError());
}
Compiled it and tested under wine and windows and get the same result (80 / 
file exists). Closing as works for me but feel free to reopen
