So the correct solution would be something like

bpath=strchr(spath, '\\');
spath=strchr(spath, '/');
if (bpath && spath)
	spath=MIN(bpath, spath);
else
	spath=MAX(bpath,spath);

?
Btw, are Unix filenames that contain a '\' a problem?
