It hardcodes the b3DAccelerationExists, b3DAccelerationEnabled, and bDDAccelerationEnabled properties to TRUE. IDirect3D9::GetDeviceCaps with D3DDEVTYPE_HAL should do. If the call suceeds you have hardware acceleration.
