The interesting question is why the Z buffer is disabled. Either the game explicitly disables it(ok), or there is no depth buffer(maybe ok, maybe not). Can you check if there's a line "No Z buffer - disabling depth test" in a +d3d log? This fixme is a side effect of the hack. It may cause rendering problems, but I suspect something else is broken.
