In that case, this bug is invalid. It only appears when you use native crypt32 from old versions of Windows. Newer versions of Windows do not work this way, as your test case demonstrated.
In your small world it is, but what if I found an app that did the same? Is this app also invalid? The newer Windows you refer to is a minority of all Windows systems.
