Giving a look to the logs with and without complex shaders enabled, I noticed that only with complex shaders enabled the depth comparison function 'D3DCMP_EQUAL' is used. So my guess is that this bug is related, as Henri hypothesized, to depth buffer precision issues.
In any case, this seems to be a different problem that, just by chance, happens with the same game settings as the one hopefully fixed by my patch.
