As indicated it *tries* to use Microsoft BITS. If you dont have BITS installed or the service is stopped it uses standard HTTP data transfers. Sniffed with wireshark:
User-Agent: SOEPatcher/curl
Host: laeaberrpatch.everquest2.com:7010
And some official statement:

There is no mention that BITS is actually required. This is not a show stopper.
The launcher/patcher works fine for me. Though it takes some time to download all the stuff.
