As far as I can see, two different commits are responsible for the bugs in the two games:
In Dungeon Siege 1 (a DX7 game) the bug is present since commit b5c249faa1b8ec67fd2f247f30789e81df0d99f3
In Dungeon Siege 2 (a DX9 game) the glitch was introduced by commit 11b734b8261554152e4180bfeae85a5153215fc2
