Hi,
As you can see in my bug report #40531, Max Payne 3 runs on Wine with the Staging Patches.
Unfortunatly, the game does not work if Wine is set to Vista and >. I know that d3d10 and d3d11 are not implemented completly but the game support : - d3d9 - d3d10 - d3d10_1 - d3d11
So, when these APIs will be implemented, it will be easier to see the graphical glitch present with d3d9 can be fixed by d3d1*

I would guess the application uses different APIs when it detects that its running on a Vista+ operating system.
Could you attach terminal output (without any special WINEDEBUG flags) for a prefix with default settings and with Vista? If there are different fixmes this could give a hint what is missing.
