this patch solves a rendering problem with instances. Affected games are Crysis and Gothic3. The test for this is in 0005-d3d9-add-stream_test-with-instancing. So apply this first, otherwise the tests will fail on wine.
I think a comment why you're breaking out of the loop here would be helpful, perhaps mentioning the testcase in d3d9/tests. The same applies to the 0 instances -> 1 instance override
