You cant use native ddraw.dll.
Also the patch creates a new file "3dmark2.exe" iirc.
You should use this one.

Can someone else confirm it's fixed first?

Looks like it's been fixed. Probably by commit
d0cf2342df427afa6d0c5f367f83b55f578e56e4.

Thanks Gregor.
This kinda works. At least I get a juicy segfault now :-)

Correction:
Calling 3dmark.exe directly in the installation directory
~/.wine/drive_c/Program Files/3DMark 99 MAX/
produces the 3dmark.ras error. Strange thing.
Calling 3dmark from ~ with
wine "C:\\Program Files\\3DMark 99 Max\\3dmark.exe"
produces the already known DirectX6.1 error. WTF?
Either way using the patched ddraw.dll as native does NOT work for me.

But that doesn't make it work with wine, does it?
I tried setting ddraw.dll as native through winecfg, but now the application
doesn't find the "3dmark.ras" file. At least that's what it says shortly after
opening the main window (and then it exits).

Here is a patch:
http://freenet-homepage.de/p.m.weber/hwluxx/3DMark99DXPatch.exe
Apply it and then run the exe through winefile. (Or use absolute path)
This worked for me in the past, currently I get a crash in wined3d maybe
someone else can confirm?
